Risk assessments are valid for twoyears but may need to be reviewed sooner if there are changes to the building, the water system or its use, signs that the current control measures are no longer adequate, or a case of Legionella/Legionellosis is associated with the system.
Whilst failure to comply to any part of the ACoP is not in itself an offence, that failure may be used in criminal proceedings in a court of law in contravention to HSWA 1974, COSHH 2002 and MHSWA 1999.

In a time where we are all trying to tighten our financial belts, a Legionella risk assessment may seem an unnecessary expense and many companies do not follow the law.
